นโยบายความเป็นส่วนตัว (Privacy Policy)

บริษัท เยลโลสทัฟ จำกัด ("บริษัท" หรือ "Yellow Stuff") ตระหนักถึงความสำคัญของการคุ้มครองข้อมูลส่วนบุคคลของลูกค้าและผู้เข้าร่วมกิจกรรมต่าง ๆ ของบริษัท นโยบายความเป็นส่วนตัวฉบับนี้จัดทำขึ้นเพื่ออธิบายวิธีการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่าน ไม่ว่าจะเกิดจากการใช้บริการที่หน้าร้าน การเข้าร่วมกิจกรรมส่งเสริมการขาย หรือช่องทางออนไลน์ของบริษัท ตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562

นโยบายฉบับนี้เป็น "ฉบับกลาง" ที่ใช้บังคับกับกิจกรรมทุกประเภทของ Yellow Stuff เว้นแต่จะมีประกาศความเป็นส่วนตัวเฉพาะกิจกรรมใดกิจกรรมหนึ่งแยกต่างหาก ซึ่งในกรณีดังกล่าวให้ถือปฏิบัติตามประกาศเฉพาะกิจกรรมนั้นควบคู่กับนโยบายฉบับนี้

2. ข้อมูลส่วนบุคคลที่เก็บรวบรวม

บริษัทอาจเก็บรวบรวมข้อมูลส่วนบุคคลของท่านดังต่อไปนี้ ขึ้นอยู่กับลักษณะการใช้บริการหรือกิจกรรมที่ท่านเข้าร่วม:

ชื่อ-นามสกุล และข้อมูลติดต่อ (เบอร์โทรศัพท์ อีเมล ที่อยู่)
เลขประจำตัวประชาชนหรือเอกสารยืนยันตัวตน (เฉพาะกรณีจำเป็น เช่น การรับของรางวัลที่มีมูลค่า หรือการออกเอกสารทางภาษี)
ข้อมูลการซื้อสินค้าและการทำธุรกรรม
ภาพถ่ายและวิดีโอจากกล้องวงจรปิด (CCTV) ภายในร้าน เพื่อความปลอดภัย
ภาพถ่ายหรือวิดีโอจากกิจกรรมหรือแคมเปญที่บริษัทจัดขึ้น (เฉพาะกรณีได้รับความยินยอมเพื่อใช้ในการประชาสัมพันธ์)
ข้อมูลจากการติดตามบัญชีโซเชียลมีเดียหรือการเข้าร่วมกิจกรรมออนไลน์ของบริษัท (เช่น ชื่อบัญชี Instagram/Facebook)

3. วัตถุประสงค์ในการเก็บรวบรวม ใช้ และเปิดเผยข้อมูล

บริษัทเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ดังนี้:

เพื่อให้บริการและดำเนินธุรกรรมตามที่ท่านร้องขอ
เพื่อดำเนินกิจกรรมส่งเสริมการขายหรือแคมเปญต่าง ๆ ของบริษัท รวมถึงการตรวจสอบสิทธิ์และมอบของรางวัล
เพื่อรักษาความปลอดภัยภายในร้านค้า (กล้องวงจรปิด)
เพื่อปฏิบัติตามหน้าที่ทางกฎหมาย เช่น การหักภาษี ณ ที่จ่ายและการออกเอกสารทางภาษี
เพื่อการประชาสัมพันธ์และการตลาด (เฉพาะกรณีที่ท่านให้ความยินยอม)

5. การเปิดเผยข้อมูลแก่บุคคลภายนอก

บริษัทอาจเปิดเผยข้อมูลส่วนบุคคลของท่านแก่บุคคลดังต่อไปนี้ เท่าที่จำเป็น:

กรมสรรพากรและหน่วยงานราชการที่มีอำนาจตามกฎหมาย
ผู้ให้บริการที่บริษัทว่าจ้าง (เช่น ระบบลงทะเบียนกิจกรรม ผู้ให้บริการด้านการตลาด) ภายใต้ข้อตกลงรักษาความลับ
ร้านค้าพันธมิตรที่ร่วมจัดกิจกรรมกับบริษัท เฉพาะเท่าที่จำเป็นต่อการดำเนินกิจกรรมนั้น

บริษัทจะไม่จำหน่ายข้อมูลส่วนบุคคลของท่านแก่บุคคลภายนอก และจะไม่เปิดเผยเพื่อวัตถุประสงค์ทางการตลาดโดยไม่ได้รับความยินยอมจากท่าน

6. ระยะเวลาในการเก็บรักษาข้อมูล

บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลของท่านเท่าที่จำเป็นตามวัตถุประสงค์ในการเก็บรวบรวม โดยทั่วไป:

ข้อมูลจากกล้องวงจรปิด: ประมาณ 30 วัน
ข้อมูลที่เกี่ยวข้องกับกิจกรรม/แคมเปญ: 1 ปี นับแต่วันสิ้นสุดกิจกรรม
เอกสารทางภาษี: อย่างน้อย 5 ปี ตามที่ประมวลรัษฎากรกำหนด

7. สิทธิของเจ้าของข้อมูลส่วนบุคคล

ท่านมีสิทธิตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 ดังนี้:

สิทธิขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคล
สิทธิขอให้แก้ไขข้อมูลส่วนบุคคลให้ถูกต้อง

สิทธิขอถอนความยินยอม (ไม่กระทบต่อการประมวลผลที่ทำไปแล้วก่อนการถอนความยินยอม)
สิทธิร้องเรียนต่อสำนักงานคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล (สคส.)

8. การเปลี่ยนแปลงนโยบายความเป็นส่วนตัว

บริษัทอาจปรับปรุงนโยบายฉบับนี้เป็นครั้งคราว โดยจะแจ้งให้ทราบผ่านช่องทางที่บริษัทกำหนด และแนะนำให้ท่านตรวจสอบนโยบายนี้เป็นระยะ

This Privacy Policy explains how the Company collects, uses, and discloses your personal data — whether arising from in-store services, participation in promotional campaigns, or the Company's online channels — in accordance with the Personal Data Protection Act B.E. 2562 (2019) ("PDPA").

This is a "master" / general policy that applies to all Yellow Stuff activities, unless a separate campaign-specific Privacy Notice is issued for a particular activity, in which case that specific notice applies alongside this policy.

Data from social media accounts or online activity participation (e.g., Instagram/Facebook account names)

3. Purposes of Collection, Use, and Disclosure

The Company collects, uses, and discloses your personal data for the following purposes:

To provide services and process transactions you have requested.
To operate promotional campaigns or activities, including verifying eligibility and issuing rewards.
To maintain security within stores (CCTV).
To comply with legal obligations, such as withholding tax deduction and issuance of tax documents.

Contractual basis — to provide services or fulfill your requests.

Consent — for the use of photographs/video footage for promotional purposes, or for sending marketing communications.

5. Disclosure to Third Parties

The Company may disclose your personal data, to the extent necessary, to:

The Revenue Department and other government authorities with lawful authority.
Service providers engaged by the Company (e.g., campaign registration systems, marketing service providers), subject to confidentiality obligations.
Partner stores that co-organize a particular activity with the Company, limited to what is necessary for that activity.

The Company will not sell your personal data to third parties, and will not disclose it for marketing purposes without your consent.

6. Data Retention Period

The Company retains personal data only for as long as necessary for the purposes of collection. As a general guideline:

CCTV footage: approximately 30 days
Data related to a specific activity/campaign: 1 year from the end of the activity
Tax-related documents: at least 5 years, as required under the Thai Revenue Code

7. Your Rights as a Data Subject

Under the PDPA, you have the right to:

Request access to and obtain a copy of your personal data.
Request correction of inaccurate personal data.
Request deletion or destruction of your personal data.
Request restriction of the use of your personal data.
Object to the collection, use, or disclosure of your personal data.
Withdraw your consent (without affecting processing carried out before the withdrawal).
Lodge a complaint with the Office of the Personal Data Protection Committee (PDPC).

8. Changes to This Privacy Policy

The Company may update this policy from time to time. Updates will be communicated through the Company's official channels, and you are encouraged to review this policy periodically.
